Successful Defense Against a Large Fine for Undeclared Currency

In March 2022, our Client, along with his family, was crossing the border of Ukraine, escaping the war like millions of our fellow citizens. While crossing the Ukrainian border at the checkpoint, the Client failed to declare currency exceeding the allowed amount, namely over USD 100,000. This situation arose because, during the large migration, customs officials were allowing people to pass without excessive formalities and verbally exempting them from the obligation to declare such currency.

However, in 2023, Ukrainian customs learned about this "violation" after receiving information from Romanian customs, where the Client had declared currency exceeding USD 100,000. According to the customs' position, failure to declare currency of such a large amount entails a fine of 20% of the undeclared currency amount. Thus, our Client faced a fine that would amount to tens of thousands of dollars.
