Foreigners can freely buy and sell land in Ukraine. For foreigners, there are restrictions only on agricultural land.
The land market in Ukraine
On July 1, 2021, the Law on the opening of the land market comes into force.
Prior to the entry into force of this law, Ukraine has a moratorium on the sale of agricultural land, which means a ban on any alienation of such land. However, it is not forbidden to use agricultural land on the terms of a long-term lease, emphyteusis, will, pledge, order, change in the purpose of the site, judicial alienation due to debts, and the like.
What to expect after the land market opens?
According to many economists, the opening of land markets in other countries was a strong boost to the economy.
It is estimated that about $ 2.5 billion is reserved by the business for the opening of the land market.
Who can buy agricultural land?
- citizens of Ukraine;
- legal entities of Ukraine, the participants (shareholders, members) of which are only citizens of Ukraine and/or the state, and/or territorial communities;
- territorial communities;
- the state;
- Bank (only in the order of foreclosure on land plots as a subject of а pledge. Such land plots must be alienated by banks at land auctions within two years from the date of acquisition of ownership).
Stages of the implementation of the land market opening.
- Stage I: July 1, 2021 - only individuals who are citizens of Ukraine can purchase agricultural land. Important: the maximum size of a land plot established by law is 100 hectares per person.
- Stage II: January 1, 2024 - in addition to individuals, legal entities will also be able to acquire ownership of agricultural land plots.
If they are created and registered under the legislation of Ukraine, the participants of which are only citizens of Ukraine and/or the state, and/or territorial communities, territorial communities and the state. Important: the maximum size of a land plot established by law is 10 thousand hectares.
